TERMS OF SERVICE AGREEMENT
This Terms of Service is a referral agreement between Clean Casa Crew and the Client. Clean Casa Crew operates as an Employment Agency/Domestic Referral Agency, assisting clients in finding house cleaners, gutter cleaners, and other independent service providers. Clean Casa Crew recruits and registers qualified professionals/domestic workers for job referrals.
By using Clean Casa Crew's services, Client agrees to the following terms:
1. Referral Service
Clean Casa Crew recruits and retains independent domestic workers. All Service Providers undergo an interview with Clean Casa Crew to assess their skills and availability.
2. Payment
Payment is due at the time services are scheduled. Client may provide a valid credit card for billing purposes. Client is responsible for paying Clean Casa Crew the full cost of requested services. Referral fees charged by Clean Casa Crew are based on a fixed percentage of the service cost per the Agency’s fee schedule. There are no refunds for cleaning services.
3. Cancellation
Failure to notify Clean Casa Crew at least twenty-four (24) hours in advance of a cancellation will result in a $99 fee. Refunds for this fee are only given in emergencies considered valid by Clean Casa Crew.
4. Lock-Out or No-Show
Client must ensure access to the premises for the scheduled service. If the Service Provider is unable to enter, a $99 lock-out fee will be charged. Refunds for this fee are only given in emergencies considered valid by Clean Casa Crew.
5. Service Provider Performance
A “walk-through” inspection is required at the end of service for quality assurance. If dissatisfied, Client must immediately contact the Service Provider. Clean Casa Crew is not liable for unsatisfactory service; the Service Provider is responsible for addressing Client concerns.
6. Direct Hiring Prohibited
Client agrees not to directly hire any Service Provider referred by Clean Casa Crew for nine (9) months after termination of services without notifying Clean Casa Crew. Failure to comply will result in a $5,000 finder’s fee payable to Clean Casa Crew.
7. Performance of Services
Service Providers are independent contractors and are solely responsible for the quality of their services. Clean Casa Crew is not liable for any issues such as unsatisfactory performance, theft, or damage, and Client agrees to indemnify Clean Casa Crew from such claims.
8. Independent Domestic Worker
Clean Casa Crew is not the employer of referred Service Providers. Client may have employer responsibilities, including tax obligations. Clean Casa Crew is not liable for Client’s failure to meet such responsibilities, and Client agrees to indemnify Clean Casa Crew from related claims.
9. Acceptance of Terms
By engaging a Service Provider referred by Clean Casa Crew, Client agrees to the terms and conditions of this Agreement, even if the Agreement is not signed.
10. Termination
Client reserves the right to replace or terminate the Service Provider at any time.
11. Attorney’s Fees
Client agrees to pay all reasonable costs, including attorney’s fees, incurred by Clean Casa Crew to enforce this Agreement.
12. Governing Law/Jurisdiction
This Agreement is governed by the laws of the state of Arkansas. Any legal actions will be brought in Benton County, Arkansas.
13. Electronic Signatures
This Agreement may be signed electronically and will be enforceable as if it were signed in person. Client may log in to Clean Casa Crew's website to accept or reject this Agreement at any time.
14. Service Fee
A 3.05% service fee will be added to all bookings.
15. Refund Policy
No refunds are available for cleaning services. If Client initiates a chargeback that is deemed fraudulent, Client agrees to pay $750 in liquidated damages in addition to service costs.
16. Background Check Requests
Clients may request a background check for any Service Provider referred by Clean Casa Crew. Clean Casa Crew will provide an attestation of completion of the background check but not the actual results.
17. Privacy Policy
Clean Casa Crew only shares Client information with third parties when necessary to provide services or when required by law. Information may be shared with independent domestic workers, payment processors, and service providers. Digital photographs may be taken on-site for internal records or marketing purposes with Client's consent.
18. SMS Notifications
By opting in for SMS notifications from Clean Casa Crew, Client agrees that message and data rates may apply. Clients can opt out at any time by replying “Stop” to any message.

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
Client acknowledges the risks of COVID-19 and agrees to release Clean Casa Crew and its affiliates from any liability related to exposure to COVID-19 during service. Client assumes all risks associated with the pandemic and agrees to take appropriate precautions.
